Default Local stations on cable

How does this regulation actually work? Don't cable providers need to offer all of them as part of the basic package?

I ask because our local PBS station runs different programming on it's HD channel then it's SD channel. So, 2-1 is their standard programming and 2-2 is the HD channel that only runs programs in HD or widescreen. So if 2-1 is running a program not available in WS or HD, they'll run something else. But it kind of dawned on me that I've got to pay extra to get access to this from the cable company. So how does the regulation work? Are HD stations excluded from that or something?
