Exclamation Microsoft Sued Over Xbox Live Outage

CNET News, January 4, 2008, by Ina Fried:

Microsoft now faces a lawsuit over recent problems with its Xbox Live online gaming service.

Three Texas residents filed a lawsuit Friday on behalf of themselves and others who have had trouble connecting to Xbox Live in recent weeks.

The suit, filed in U.S. District Court in Houston, claims Microsoft's outages represent a breach of contract and negligent misrepresentation for which the software maker is liable. The suit doesn't claim specific damages, but notes the amount is in excess of $5 million.

In the suit, the plaintiffs allege that Microsoft should have known strong holiday sales would tax its servers. "Microsoft knew the increase in subscriptions would increase game-play on its servers, yet failed to provide adequate access and service to Xbox Live and its subscribers.

Microsoft has apologized for the outage and said it would allow Xbox live subscribers to download a free game.

Please.. this doesn't have a chance. 5 Million just because there were some hiccups for a week? Get over it. It's inconveinent sure, but not that big of a deal. MS is going to be reimbursing it's members, and technically the service wasn't completely down.. just hindered. Nothing would please me more then for MS to find someting worth counter suing these losers for and nailing them to the wall... (Something like modding and pirating for instance.)

Other than your highly subjective view, Microsoft enters into a binding contract with a consumer who purchases the xbox live service. There may be grounds, but noone on this board is probably qualified to correctly determine the strength of their case.

That's why the 12 month Xbox Live subscription I received as a gift hasn't been registered yet. I had a feeling servers would've been crashed or something for the holidays.

Its failure to provide the product the consumer has paid for. We'll see if it has legs or MS may just say 3 months for free to all.

This is the umpteenth time in the history of paid services that an outage type problem has presented itself. It has no legs at all, not counting the fact that service wasn't even completely shut down.

The persons involved in the filing of this lawsuit need to take a long walk off of a short dock and rid the legal system of this mockery.

no matter what, a 12 month span will hit a holiday season, though

wickedly stupid WHINY lawsuit, but most are. At least they aren't asking for 52 million for some pants or anything

Unless their is a QoS statement in the Live contract then this has little chance to do anything.

MS is already "rewarding" folks for an Arcade game.
