Thanks for the comments guys. Now that the pictures have been taken and the stuff has been wiped down, alot more damage to the TV is visible. Long scratches across the entire width of the LCD panel and the frame. They came and cleaned up the mess of dust today, completely wiping down everything and cleaning the adjacent rooms that were open at the time of the "accident".

The guys really do seem to be trying to make good on cleaning everything up but I still think they are a little gunshy of replacing the receiver (the TV will definitely get replaced). I understand even $1000 is alot for a company to just swallow, I mean, that could be someone's Christmas bonus or something. I just don't think it's fair that I should have to be accountable for the possibility of problems down the road with my electronics.

Is this all worth it if my Blu-ray player is cleaned out and then only works for 4 years instead of 6? Should I just live with a scratched TV or one thats been sent in, dissected and had parts replaced? I have never sent in anything in my life for repairs or cleaning and I wasn't about to start now.

Chime in guys, I'd love to know how you would deal in my sitch.

I noticed that your t.v. is a Viewsonic. Did you get it from Costco? I ask because I bought mine from Costco and took it back to get replaced. If you did, you can take it back within the year if you still have the box and the recite. Just have the remote on top (so they don't have to take the whole thing out of the box so they don't see the scratches.) They always check for that.

On a side note, I was at Costco today to buy a HDMI cable (all sold out.) and I noticed they reduced the price of the 42" Viewsonic (1080p) to $1099.99. If you get the cash you should think of getting that instead of the 37"

So I talked with my lawyer friend and she suggested taking a ton of pictures (which you have already done) and if you are not satisfied taking them to small claims court. Not sure of the limit at small claims court in Canada (or if you even have such a thing), maybe you would be over it.

I guess lawyers only want to give you advice when they are getting paid (even when they are your friend). Wish I had better info for you.

Thanks for trying ATLfalconsFAN, i do appreciate it. That is pretty much the route I've been told to go by a few people who are familiar with claims like this.

Pictures to come later tonight. I'll post them in the original post.

They are to blame no question. Sounds like that they could have taken steps to be a bit more careful around your electronic gear. No phone call?? No heads up?? Are they arguing with any of their liability and your responsibility?? I mean...I can see them saying that it was your responsibility to take care of your personal property. Although, if I was having contractors in to do a job like that I would think they would be professional enough to advise you about anything that should be taken out of the area. I feel your pain and anger. That stuff is not cheap and any hi def enthusiaist knows that dust is the enemy. Man...that would burn me.

I am one of those persons who has thrown an octopi at a Wings game in the Cup Finals in 2002. That will be my first and last time as they smell like ass.

I don't know. you have to becareful with the way you handle things. I have two close friends who are attorneys and it can go either way. Since it is your property and it is in the work area, it is expected that it will get dirty and you should have been responsible for covering or moving fragile material. it is like having new cabinets put in but leaving the dishes in the old cabinets as they are taken down...they should be careful but things happen.

Besides that it can also be looked at as their fault for not laying proper covers on the area (if they were instructed) and attempt to cover things up.

    Could go either way...

Let's put it this way, if you force them to replace it, they will be guaranteed to make damn sure that it ever happens again. That's how restitution works.
