Although Max Payne 3 managed to secure the number two spot in last month's NPD numbers, actual sales figures suggest Rockstar's latest has seriously underperformed. According to NPD stats, Max Payne 3 managed to sell 440K units.
While that number may seem impressive to some, it is a far cry from the first-month sales of Rockstar's big 2011 game, LA Noire. That game sold nearly 900K units, but even that game fell short of industry expectations. With Max Payne selling even fewer copies, it's unsurprising that Wedbush Securities analyst Michael Pachter would call the game "a flop."
Pachter points out the game's eight-year development, and claims "Rockstar put off releasing GTA" to work on Grand Theft Auto V. Rockstar has admitted that the long-troubled development of Max Payne 3 eventually required the work of many of its global studios.
It's clear that Take-Two Interactive, parent company of Rockstar, was betting big on Max Payne 3's success. In its last financial report, Take-Two claims retail sell-in of about 3 million units. With only 400K units sold, that means there is about 2.6 million units of unsold inventory sitting on store shelves.

Sega didn't negotiate the rights to the name and engine, Sega sold off its entire division, including the studio to Take Two, and the brand name 2K is now too big to just sell off to another publisher.
And 2K never had exclusive rights to begin with, otherwise MLB The Show wouldn't exist. They became the only third party to license MLB games once EA bowed out. The MLB2K name is dead until Take Two brings it back via 2K Games.Great quotes on the internet:

Rockstar branding really, but yeah, it was the 3rd installment after an 8 year hiatus, it's not an open world game that Rockstar is known for, and L.A. Noire may have impacted the brand a bit considering the post reception
Despite this, I really enjoyed it a lot. I strongly recommend people pick it up on the cheap later on if they're not willing to take the risk nowDon't Reach, Young Blood
